When you start a chat with Moku you are asked to check an "I agree" box; that checkbox is your explicit acknowledgement of these Terms. If you do not agree, please do not use the site.

2. About This Site
mokuintel.com is a hybrid platform: it is both a Kauaʻi real-estate listings and content site AND a software (SaaS) toolkit running AI-powered research tools on top of the same data. It is operated in partnership with Henry Beam, a licensed Hawaiʻi real estate agent (RS-87501).

- Licensed real-estate services (buyer/seller representation, showings, offers, comp pulls, transaction work) — provided separately by Henry Beam under Hawaiʻi licensing requirements, and only after a written representation agreement is signed.
3. Moku — What the AI Does and Doesn't Do
Moku is the AI chat assistant (an "AI agent") on this site. It is powered by a large language model and a set of structured tools that read live Hawaiʻi MLS data, AIRROI vacation-rental analytics, and our editorial content library.

- Pull AIRROI zone-level vacation-rental data (ADR, occupancy, RevPAR ranges).
- Read our published condo profiles, area guides, and lifestyle content and answer questions about them.
- Generally describe how concepts like cost segregation, the 7-day rule, REPS, 1031 exchange, or §199A work — at a definitional level only.
- Schedule a call with Henry Beam when you're ready to talk to a licensed person.
- Provide tax advice, compute your specific tax savings, evaluate whether a tax strategy applies to your facts, or produce a personal tax plan. Tax questions belong to your CPA.
- Provide legal advice, interpret contracts or agency agreements, or draft any legal instrument. Legal questions belong to a licensed attorney.
- Provide investment or financial-planning advice, predict property appreciation, or guarantee rental income. Investment questions belong to a licensed financial advisor.
- Tell you whether a specific listing will cash-flow, whether you qualify for any program, or what offer to make. Those are calls for Henry Beam, your CPA, or your lender — not the AI.
- Steer you toward or away from neighborhoods based on any protected class (see Fair Housing below).
4. AI Limitations — Always Verify
Moku is an AI and can make mistakes. AI responses may be incomplete, outdated, or factually wrong. They may misremember details about a listing, miscite an IRS publication, misread an area map, or confidently state something that turns out not to be true. This is a known limitation of all current AI systems.

- Real estate facts (listing details, comps, agency, offer terms, contracts) — verify with Henry Beam or another licensed Hawaiʻi Realtor.
- Tax topics (cost seg, depreciation, REPS, 1031, §199A, deductions, recapture) — verify with a licensed CPA, ideally one with Hawaiʻi short-term-rental experience.
- Legal topics (contracts, trusts, agency agreements, disclosure obligations, entity structure, Bill 9 exposure) — verify with a licensed attorney.
- Zoning & permitted use (VDA, NUC, Minatoya, parcel-level STR eligibility) — verify with the County of Kauaʻi Planning Department.
- Financing (rates, qualification, DSCR, loan structure) — verify with a licensed mortgage lender.
5. AIRROI & Third-Party Data
Vacation-rental performance figures on this site (ADR, occupancy, RevPAR, projected gross, comparable Airbnb data) are sourced from AIRROI, a third-party data provider. We surface AIRROI data unmodified — we do not adjust, smooth, or re-compute the underlying figures. The "as of" date for any AIRROI-derived number is shown alongside it where practical.
AIRROI data is zone-level, not unit-level. It reflects how comparable listings in a defined geography have performed over a trailing window. The actual performance of any specific unit depends on management quality, photography, reviews, amenity, oceanfront exposure, seasonality, owner blocks, and many other factors that zone averages cannot capture.
Before relying on any AIRROI-derived figure for a purchase decision, an offer, or a loan, you should verify it against the subject property's actual rental performance — historical owner statements, AirDNA pulls, property-manager books, or an analysis from a licensed appraiser or CPA. Zone averages are a starting point for research, not a substitute for unit-level diligence.
Other third-party data sources used on this site include the Hawaiʻi MLS (HIS, when integrated), RentCast, Perplexity (web research), Mapbox (mapping and geocoding), and FRED (Federal Reserve macro series). The same caveat applies: data is provided by third parties, may be delayed or incomplete, and should be cross-checked against primary sources before any material decision.

6. Educational Tools — Illustrative Only
The interactive tools on this site (the cost-segregation estimator at /estimate, the STR address checker at /str-data/property, the Property Analyzer waitlist at /analyzer, the rental-income tool at /kauai-rental-income-tool, the leaderboards, and the maps) present illustrative educational projections. They are based on published IRS guidance (Publications 925, 527, 946; IRC §§167/168/280A/469/1031/199A), AIRROI zone-level comps, the County of Kauaʻi's published VDA maps, and Freddie Mac / FRED macro data. They use sensible default assumptions and clearly framed ranges.
Where these tools illustrate how a tax strategy could apply to a property, they use a hypothetical sample-investor frame — "Sam, a sample investor in this situation, could see a year-one deduction in the range of X–Y% of purchase price under typical condo reclass and 2026 bonus depreciation rules, subject to CPA review of §469 material-participation tests." Tax savings estimates, depreciation projections, rental income benchmarks, property valuations, and investment analyses on this site are estimates based on general assumptions and publicly available data. We make no guarantees about specific tax outcomes, investment returns, rental income, property appreciation, financing approval, or any other financial result.

Henry Beam is a licensed real estate agent in the State of Hawaiʻi, license number RS-87501. Licensed real-estate services (buyer/seller representation, showings, offer preparation, comp pulls, transaction work, MLS access) are provided under applicable state licensing requirements and only after a written representation agreement is signed.

9. Separation of Roles — Not a CPA, Attorney, or Advisor
Neither Henry Beam nor Moku provides CPA services, tax preparation, legal counsel, cost-segregation engineering, property management, mortgage origination, appraisal, or investment-advisory services. Where referral relationships exist with CPAs, tax attorneys, lenders, property managers, cost-seg engineers, or other licensed professionals, those relationships will be disclosed in writing before any referral fee is paid.
10. Fair Housing
Moku Intel complies with the Fair Housing Act (42 U.S.C. § 3601 et seq.), the REALTOR® Code of Ethics, and Hawaiʻi Civil Rights Commission regulations. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, ancestry, age, gender identity, sexual orientation, or marital status. Our content and AI tools describe neighborhoods by features (walkability, amenity, surf, golf, school distance, price tier) — never by who lives there. 11. Voice Agent & Phone Communications
This site may offer AI-powered voice agent services via phone. Voice calls may be recorded, transcribed, and analyzed for quality and training purposes. By calling or accepting a call from a Moku Intel voice agent, you consent to recording and transcription. Transcripts may be stored in our CRM for follow-up. You may request a direct call with the licensed Realtor instead of the voice agent at any time.
12. Chat Logging & Lead Communications
Conversations with Moku are logged so that Henry Beam can follow up with relevant information. By chatting, you consent to this logging. Lead information you submit (name, email, phone) is stored in our CRM and used to follow up about your inquiry and related Kauaʻi opportunities. You may opt out of marketing communications at any time. See our Privacy Policy for full details.
13. Acceptable Use
You agree not to: scrape or systematically harvest content from this site; reverse-engineer the AI tools; submit prompts designed to extract underlying system instructions; use the AI tools to harass, defraud, or impersonate any person; or use the site for any unlawful purpose.
14. Limitation of Liability
To the fullest extent permitted by law, Moku Intel, Henry Beam, and our affiliates disclaim all liability for any damages arising from your use of this website, the AI tools, the voice agent, or your reliance on any content presented here. This includes direct, indirect, incidental, consequential, and punitive damages. Your exclusive remedy for dissatisfaction with the site or any tool is to stop using it.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
16. Governing Law & Contact
These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-laws provisions. Disputes will be resolved in the state or federal courts located in the State of Hawaiʻi.
